General Terms and Conditions of Sale

These General Terms and Conditions of Sale (GTC) govern the contractual relationship between ToolMatch (the "Provider") and any natural or legal person (the "Customer") subscribing to a Premium or Team plan on the ToolMatch platform.

ToolMatch offers four service tiers: • Free plan (€0): access to basic tool comparison, battle, battery comparator and recommendations. • Premium plan (€21.99 incl. tax/month): access to all AI features (Scan & Match, Trade Kit, Import & Match, Purchase Assistant, Voice Assistant), TCO Calculator, custom price alerts, QSE data & certifications, and priority support. • Premium Pro plan (€48.99 incl. tax/month): includes everything in Premium, plus ToolPulse (fleet management), Ecosystem Simulator, AI failure prediction, smart rent-vs-buy, smart replacement, data export and dedicated support. • Enterprise plan (on quote): multi-user access, multi-site fleet management, analytics dashboard, dedicated onboarding, guaranteed SLA and API.

Prices are shown in euros, all taxes included (VAT). Payment is made by credit card via our secure payment partner. The Premium subscription is billed monthly, on the anniversary date of the subscription. The Customer can view their payment history at any time from their personal space.

The Premium subscription is taken out for an indefinite period. The Customer may cancel at any time from their personal space, with no fees or penalties. Cancellation takes effect at the end of the current billing period. No pro-rata refund is given for the started period. The Customer's data remains accessible in read-only mode for 90 days after cancellation.

In accordance with Article L221-18 of the French Consumer Code, the Customer has a period of 14 days from subscription to exercise their right of withdrawal without having to justify reasons or pay penalties. To exercise this right, the Customer must send a clear request by email to the address indicated in the Contact section. The refund is issued within 14 days of receipt of the request.

ToolMatch undertakes to provide information that is as accurate as possible on the referenced tools. However, the technical data (scores, prices, specifications) is provided for information only and may change. ToolMatch cannot be held responsible for purchasing decisions made based on the information present on the platform. The Customer is invited to verify the specifications with the manufacturer before any purchase.

ToolMatch undertakes to protect the Customer's personal data in accordance with the General Data Protection Regulation (GDPR). The data collected (email, name, tool fleet data) is strictly necessary for the provision of the service. It is neither sold nor transferred to third parties. The Customer has a right of access, rectification and deletion of their data, exercisable at any time from their personal space or by email.

All content present on the ToolMatch platform (texts, scoring algorithms, interface, logo, brand) is protected by intellectual property law. Any unauthorized reproduction, modification or exploitation is prohibited.

ToolMatch reserves the right to modify these GTC at any time. Changes are notified to the Customer by email with 30 days' notice. In case of disagreement, the Customer may cancel their subscription without charge before the new conditions come into effect.

These GTC are governed by French law. In case of dispute, the parties will endeavor to find an amicable solution. Failing that, the French courts shall have sole jurisdiction.
